I want to report my step-dad for false marriage fraud for a green card

My mom married my step-dad in 2015, and brought my step-dad and his son A in December 2015 on an immigrant visa for spouse I think. My mom and step-dad live together with their son, and my step-dad son in a house. They also co-own a business together. However, my step-dad provided most of the financial support for both the house down payment and the cost for the business.

I want to report my step-dad for false marriage fraud for several reasons:

  1. He lied to my mom about having son A (saying that son A was a result of his ex-wife's extramarrital affair), and she didn't know until after she gave birth to his son B and them coming to the US.
  2. In a recent argument (with video evidence), he claims that she owes him and his ex-wife money because his ex-wife provided the money for the house down payment. He says that my mom is in debt to him.
  3. In the video, he also says there is no longer any kind of warmness/love for each other, and that other than the money she makes from the business, she is not allowed to touch the business money.
  4. Once they fought, and he took son B from my mom in order to get my mom to agree to what he wanted. They were in a parking lot and he drove away with son b.
  5. Among that, my step-dad might've hit my mom before, but I am unsure because I wasn't there to witness it. These are signs of emotional abuse and him being very controlling and manipulative, and I am just wondering if they would qualify as committing marriage fraud. I don't know what my step-dad original intentions are when he came here, but it is clear in this past year that he doesn't really care for her, and is just using her to obtain a legal residence here in the US for him and his son A (so that his son can go to school and live and work here in the future) and for my mom to continue working in the business so that he can make money and for her to pay her debt to him. My mom will not take any actions against him, that I know of such as going through a divorce because she has to worry about her son B, and worried about raising him without a dad, among other things. My step-dad is also very manipulative, and since the fourth incident, I am not sure what he would do if my mom tries to divorce him. I am worried that if I don't take actions, my mom will be sort of 'enslaved' by my step-dad and he will continue to emotionally manipulate her with her son.

So I am wondering that if I come forth with evidence to the immigration department, will my step-dad be charge with marriage fraud, and would my mom also be held at fault.

Sorry you’re in such a crappy situation.

Your step dad sounds like a piece of shit but from what you said, I don’t see how you’d prove he commuted immigration fraud, specially if your mom doesn’t even want to divorce him.
